§ 17.24.040. Nonconforming buildings, structures and uses—Discontinued uses—Unsafe buildings.

  • A.

    A nonconforming use of a building or land which has been discontinued or abandoned shall not thereafter be returned to such nonconforming use. A nonconforming use shall be considered discontinued or abandoned when the premises have been devoted to another use, and when the intent of the owner to discontinue is apparent, or when the characteristic equipment and the furnishings of the nonconforming use have been inoperative for two years or removed from the premises and have not been replaced by similar equipment within two years.

    B.

    If a nonconforming building or a building containing a nonconforming use is declared unsafe by the director of inspections, it shall not thereafter be restored, repaired or rebuilt except in conformity with the regulations of the district in which it is located.
